MEDIATION

Is Divorce Mediation in New Jersey right for you and your spouse?

Divorce Mediation in New Jersey is a voluntary process of self-determination, meaning you and your spouse create your own Agreement with the aid of a Mediator who acts as a facilitator of the negotiations. Your Mediator can give you legal information, but not advice. A mediator will make sure all of the appropriate issues are addressed but cannot declare the Agreement ‘fair” to either Party as the mediator does not represent either party in the divorce mediation.

With Divorce Mediation in New Jersey You Will Only Set Foot in a Courtroom Once to Finalize Your Agreement.

Generally (but not always) each Party will also have his or her own local attorney, whether it be an Elmwood Park attorney, or attorney from elsewhere in New Jersey, to review the final document created through mediation which is called a Memorandum of Understanding. This document will form the basis of a Property Settlement Agreement that is ultimately prepared by one of the Parties attorneys.

The entire process is generally much less costly and happens completely out of Court. You will ultimately still appear in Court just to finalize the matter but all of the issues will be resolved prior to a quick Court appearance.

Choose to Mediate With Kathryn A. Gilbert as Your Fair Lawn Attorney Today.

This process is good for couples who are amicable, have a degree of trust in the other, prefer to keep their affairs private and to save money. It prevents the Court from “dictating” terms that quite possibly neither you or your spouse are happy with.

I am a qualified Mediator pursuant to R 1.40 and have been involved in many mediations since 1995. From Fair Lawn attorney representation, to assistance in Fort Lee and Hackensack, I can help mediate your case and bring closure to this chapter in your life.
